Alabama Breath Test


In Alabama, breath test machines are used by law enforcement agents to determine whether or not the driver is intoxicated. These machines use infrared light to determine the driver’s blood alcohol content (BAC). The alcohol absorbs the light, and the remaining light is then measured at the end of the chamber.

You have probably heard this called a Breathalyzer test. However, this is just the name brand of a particular machine that used to be commonly utilized. Today, the most popular machine is the Intoxilyzer 5000 or 1400. The BAC Datamaster is another brand that is popular across the nation.

The problem with these machines is that they are not always accurate. Chewing gum, mouthwash, and mints may provide false readings. Physical conditions such as dental problems or acid reflux may also render an inaccurate test result.

The machines will also be inaccurate if they are not calibrated and/or maintained. Likewise, improper use of the machine by the administering officer can adversely affect the test results.

In the late 90’s, Alabama’s state lab conducted experiments on the Intoxilyzer 5000 that were used across the state. The lab found that the results of a driver with an elevated body temperature could have an error of plus or minus 25 percent. These false readings would lead a false accusation of the driver. Because of this, Alabama switched to a new breath test machine made by Draeger. This machine measures the breath temperature and adjusts the reading downwards.

There are penalties that come with the breath test, whether you take it or not. If you take the test, and are over the limit, you are subject to an administrative license suspension. This is separate from any criminal penalties you may face.
